TERMS OF SERVICE – TRUSTED SECURITY TESTERS

ACCEPTANCE
By providing SMS Opt-In consent you agree to these Terms of Service (the “Terms”) and our Privacy Policy. If you do not accept the Terms, do not submit the SMS-Opt in form.
DESCRIPTION OF SERVICE
We provide a dedicated outbound SMS channel for trusted security testers to provide security‑related communications (“Service”). The Service is powered by Twilio and operates solely as a message receipt conduit; we do not guarantee any response time or resolution.
ELIGIBILITY
- You must be at least 18 years old.
- You must be an approved participant in our Trusted Security Testing program (e.g., you have signed contract for services).
- By using the Service, you represent that you have the right to submit the information you send.
YOUR OBLIGATIONS
- Accurate Information – Provide your correct phone number and ensure the message content is truthful and complete.
- Proper Use – Use the SMS channel ONLY for security‑testing communications related to our programs.
- Confidentiality – Only vulnerability testing is what you will receive from us through this channel unless explicitly allowed.
- Compliance – Trusted Security Testers follows all applicable laws, regulations, and the specific rules of each testing engagement.
- MESSAGE CONTENT & OWNERSHIP
- By agreeing to receive SMS communications, you grant us a non‑exclusive, worldwide, royalty‑free license to use, store, reproduce, and share that content solely for:
• Processing the report,
• Communicating with you,
• Auditing and improving the testing program,
• Legal or compliance purposes.
- This license terminates automatically when we delete your data per our retention policy.
PRIVACY
Your use of the Service is governed by our Privacy Policy. The Policy forms part of these Terms by reference.
SECURITY & RELIABILITY
- We strive for high reliability but make no guarantees regarding uptime, message delivery speed, or uninterrupted service.
- Twilio may experience outages; we are not liable for delays caused by third‑party infrastructure.
- You acknowledge that SMS is NOT a fully secure channel (messages travel in plain text over carrier networks). For highly sensitive data, use the encrypted portal we provide.
INTELLECTUAL PROPERTY
All trademarks, logos, and brand assets of Trusted Security Testers remain our exclusive property. Nothing in these Terms grants you any right to use them except as needed to identify your participation in the testing program.
DISCLAIMER OF WARRANTIES
The Service is provided “as is” and “as available”. We expressly DISCLAIM ALL WARRANTIES, whether express, implied, statutory, or otherwise, including but not limited to:
- Merchantability,
- Fitness for a particular purpose,
- Non‑infringement,
- Accuracy of message handling.
LIMITATION OF LIABILITY
To the maximum extent permitted by law:
- We will not be liable for any indirect, incidental, special, consequential, or punitive damages (including loss of profits, data, or goodwill) arising from your use of the SMS Service.
- Our total cumulative liability for any claim shall not exceed USD 5,000 per engagement per calendar year.
INDEMNIFICATION
You agree to defend, indemnify, and hold harmless Trusted Security Testers, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, or expenses (including reasonable attorneys’ fees) arising out of:
- Your breach of these Terms,
- Your misuse of the Service,
- The content of your messages.
TERM & TERMINATION
- Term: These Terms remain in effect until either party terminates them.
- Termination by You: Simply stop sending SMS messages; you may also request deletion of your data (see Privacy Policy).
- Termination by Us: We may suspend or terminate your access at any time, with or without notice, for:
• Violations of these Terms,
• Abuse of the Service,
• Changes to our testing program,
• Legal requirements.
Upon termination, we will delete all retained data within the normal retention period unless a longer hold is required for legal reasons.
GOVERNING LAW & DISPUTE RESOLUTION
- Governing Law: These Terms are governed by the laws of the State of North Carolina, United States, without regard to conflict‑of‑law principles.
- Venue: Any action arising out of or relating to these Terms shall be brought in the state or federal courts located in Montgomery County, NC.
- Alternative Dispute Resolution (optional): Before filing a lawsuit, parties agree to attempt a non‑binding mediation conducted by an agreed third‑party mediator.
